TERMS OF SERVICE

1. Introduction

Welcome to NUVEE Fashion (“NUVEE”, “we”, “our”, or “us”). These Terms of Service (“Terms”) constitute a legally binding agreement between you (“Customer”, “User”, or “you”) and NUVEE Fashion, governing your access to and use of our website, mobile interface, and any services, content, or products offered through them (collectively, the “Platform”).

By accessing the Platform or completing a purchase, you confirm that you have read, understood, and agreed to be bound by these Terms and all policies incorporated herein by reference. If you do not agree, please discontinue use of the Platform immediately.

2. Eligibility

The Platform is intended for persons who are at least 18 years of age, or the age of majority in their jurisdiction, whichever is higher. By using the Platform, you represent and warrant that you meet this eligibility requirement. If you are placing an order on behalf of a business entity, you further represent that you have the authority to bind that entity to these Terms.

3. Account Registration & Security

Certain features of the Platform require you to create an account. When registering, you agree to:

  • Provide accurate, current, and complete information.
  • Maintain and promptly update your account information to keep it accurate.
  • Keep your password confidential and not share it with any third party.
  • Notify us immediately at support@nuveefashion.com upon becoming aware of any unauthorised access to your account.

NUVEE reserves the right to suspend or terminate any account that we reasonably believe has been used fraudulently, in breach of these Terms, or in a manner that may harm other users or the Platform.

4. Product Descriptions & Availability

We take care to represent our products accurately through photographs, descriptions, and material information. However, colour rendering may vary depending on your device settings and screen calibration. NUVEE makes no warranty that product colours, textures, or patterns will appear exactly as displayed.

All products are subject to availability. We reserve the right to limit quantities, discontinue products, or decline orders at our discretion, including after an order confirmation has been issued. In such cases, the affected order will be cancelled and a full refund issued within 7 working days.

5. Pricing & Payment

All prices listed on the Platform are in Indian Rupees (INR) unless otherwise stated and are inclusive of applicable Goods and Services Tax (GST). NUVEE reserves the right to revise pricing at any time without prior notice; however, the price applicable to your order at the time of confirmed payment will be honoured.

Accepted payment methods include major credit and debit cards, UPI, net banking, and select buy-now-pay-later instruments. Payments are processed through PCI-DSS compliant third-party payment gateways. NUVEE does not store your full card details on its servers.

In the event of a failed payment where your account has been debited, any such deducted amount will be refunded to your original payment method within 5 to 7 working days, subject to your bank’s processing timelines.

6. Order Placement & Confirmation

Placing an item in your cart does not constitute a binding order. An order is accepted and a binding contract formed only when:

  • You have completed the checkout process and received an order confirmation email or message from NUVEE.
  • Payment has been successfully processed and verified.

NUVEE reserves the right to refuse or cancel any order at any stage, including after confirmation, for reasons including but not limited to product unavailability, pricing errors, or concerns regarding fraud or misuse.

7. Intellectual Property

All content on the Platform, including but not limited to logos, brand names, photographs, product descriptions, editorial copy, graphic elements, and video assets, is the intellectual property of NUVEE Fashion or its licensors and is protected under applicable Indian and international intellectual property laws.

You may not reproduce, distribute, modify, create derivative works of, publicly display, or commercially exploit any content from the Platform without our prior written consent. Unauthorised use may give rise to a claim for damages and/or constitute a criminal offence.

8. User Conduct

You agree not to use the Platform to:

  • Post, transmit, or distribute content that is unlawful, defamatory, obscene, harassing, or otherwise objectionable.
  • Impersonate any person or entity or misrepresent your affiliation with any person or entity.
  • Attempt to gain unauthorised access to any part of the Platform or its related systems.
  • Use automated tools to scrape, crawl, or harvest data from the Platform.
  • Engage in any conduct that could damage, disable, or impair the Platform’s functionality.

9. Third-Party Links & Services

The Platform may contain links to third-party websites, payment gateways, social media platforms, or logistics partners. These are provided solely for your convenience. NUVEE has no control over such third-party content and accepts no responsibility for their privacy practices, terms, or accuracy. Accessing any third-party site is done entirely at your own risk.

10. Disclaimer of Warranties

The Platform and all products and services offered through it are provided on an “as is” and “as available” basis, without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, or non-infringement, to the fullest extent permitted by law.

NUVEE does not warrant that the Platform will be uninterrupted, error-free, or free of viruses or other harmful components.

11. Limitation of Liability

To the fullest extent permissible under applicable law, NUVEE Fashion, its directors, employees, partners, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Platform or any products purchased through it, even if NUVEE has been advised of the possibility of such damages.

Our aggregate liability to you in respect of any claim shall not exceed the amount actually paid by you for the product or service giving rise to that claim.

12. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of India. Any dispute, controversy, or claim arising out of or in relation to these Terms, including their formation, validity, breach, or termination, shall first be sought to be resolved through good-faith negotiation.

If such negotiation fails within 30 days, the dispute shall be referred to binding arbitration under the Arbitration and Conciliation Act, 1996, conducted in Udaipur, Rajasthan, in the English language. The award of the arbitrator shall be final and binding on both parties.

Nothing in this clause shall prevent either party from seeking urgent interim or injunctive relief from a court of competent jurisdiction.

13. Changes to These Terms

NUVEE reserves the right to revise these Terms at any time. Changes will be effective immediately upon posting to the Platform. Your continued use of the Platform following any update constitutes acceptance of the revised Terms. We encourage you to review these Terms periodically.
